ORDINANCE NO. 28, FOURTH SERIES
AN ORDINANCE AMENDING LUVERNE CITY CODE CHAPTER 111: ALCOHOLIC BEVERAGES, AMENDING SECTION 111.001 DEFINITIONS, AND ADDING
SECTION 111.065 OFF-SALE MALT LIQUOR “128 OUNCES”
THE CITY OF LUVERNE DOES HEREBY ORDAIN:
SECTION 1. That City Code Chapter 111, Alcoholic Beverages, amending
section 111.001 definitions, is hereby amended to read as follows:
§ 111.001 DEFINITIONS.
OFF-SALE MALT LIQUOR (128 OUNCES) Brewer off-sale malt liquor licenses may also be issued, with approval of the commissioner, to a holder of a brewer’s license under Minn. Stat. § 340A.301, subd. 6(c), (i) or (j) and meeting the criteria established by Minn. Stat. § 340A.29 as may be amended from time to time. The amount of malt liquor sold at off-sale under this license may not exceed 128 ounces per customer per day.
§ 111.065 OFF-SALE MALT LIQUOR “128 OUNCES”
A brewer licensed under M.S. § 340A.301, subd. 6(c), (6)(i) or (6)(j), as they may be amended from time to time, may be licensed for the “off-sale” of malt liquor produced and packaged on the licensed premises, subject to the following conditions.
(A) No off-sale of malt liquor may be made between 2:00 a.m. and 10:00 a.m.
on Sunday, nor between 2:00 a.m. and until 8:00 a.m. on Monday, nor between
the hours of 2:00 a.m. and 8:00 a.m. on any weekday.
(B) The amount of malt liquor sold at off-sale under this license may not exceed
128 ounces per customer per day.
(C) The malt liquor sold at “off-sale” must be removed from the licensed premises
before the applicable closing time at exclusive liquor stores.
(D) Packaging of malt liquor for off-sale under this license must comply with the provisions of Minnesota Rules, parts 7515.1080 to 7515.1120, as they may be amended from time to time.

is hereby renumbered as follows:
§ 111.066 BREWER TAPROOMS.
SEC. 3. This ordinance takes full force full force and effect upon its publication.
