PUBLIC NOTICE AND OPPORTUNITY FOR COMMENT

The City of Luverne proposes to construct a new storm water detention basin along the east side of Highway 75 between W Dodge St and W Adams Ave. This project would include storm water improvements adjacent to the highway, construction of a storm water detention basin, and new storm sewer improvements to connect to the existing storm sewer system.

In accordance with Section 6009 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act:  A Legacy for Users (SAFETEA-LU) Public Law 109-59, enacted August 10, 2005, the City of Luverne is soliciting comments on the effects this project would have on Sitting Bull Park. The project will impact less than 0.12 acres of the park for a storm sewer pipe to be constructed through the park, connecting to the existing storm sewer on N. Estey Street. Park access will be closed while the new storm sewer is constructed through the north side of the park. Two pieces of equipment will be temporarily removed during construction, and will be reinstalled upon completion of the project.

It is anticipated that the City of Luverne will request the Federal Highway Administration (FHWA) to determine that the proposed action at Sitting Bull Park is a Section 4(f) de minimis action in accordance with Section 6009(a) of SAFETEA-LU. A de minimis finding may be made when uses of Section 4(f) land will have no adverse effect on the protected resources.
